Frequently Asked Questions ABOUT Mediation

What is mediation?

Mediation is a confidential and voluntary process in which a neutral third party helps individuals or organizations communicate more effectively, resolve disagreements, and reach mutually acceptable solutions. Unlike a judge, a mediator does not make decisions or take sides. The parties remain in control of the outcome.

Do both parties have to agree to mediation?

Yes. Mediation is a voluntary process. Both parties must willingly agree to participate and be committed to working toward a mutually acceptable resolution.

Do I need an attorney?

No. Many disputes are successfully resolved through mediation without attorneys. However, you are welcome to consult with an attorney before, during, or after the mediation process if you choose.

Is mediation less expensive than going to court?

In most cases, yes. Mediation is generally much faster and significantly less expensive than litigation. It also allows the parties to maintain control over the outcome instead of leaving the decision to a judge.

How long does mediation take?

Every case is unique. Some disputes can be resolved during a two-hour session, while more complex matters may require a half-day or full-day mediation. During your consultation, we'll discuss the amount of time that is most appropriate for your situation.

What happens during a mediation session?

The mediator begins by explaining the process and establishing ground rules for respectful communication. Each party has an opportunity to share their perspective without interruption. The mediator then facilitates productive discussion, identifies common interests, explores possible solutions, and works toward an agreement that both parties can accept.

Can mediation be conducted virtually?

Yes. Chattanooga Conflict Solutions offers both in-person and virtual mediation services. In-person sessions are available for clients in the Chattanooga area. If you are located outside the greater Chattanooga area, mediation sessions will be conducted virtually using a secure online platform, allowing clients throughout Tennessee to participate conveniently.

How are mediation fees paid?

In most cases, the parties agree to split the mediation fee equally, with each party paying one-half of the total cost.

Is a deposit required?

Yes. To reserve your mediation session, a non-refundable deposit equal to 50% of the scheduled mediation fee is required at the time of booking.

What To Expect

At Chattanooga Conflict Solutions, our goal is to create a calm, respectful environment where everyone has the opportunity to be heard. Mediation is a confidential, voluntary process designed to help people find practical solutions without the stress, expense, and uncertainty of going to court.

Pre-Mediation

Consultation Phase--All consultations are virtual

Step 1: Private Individual Meetings

Every mediation begins with a private meeting between the mediator and each party separately. These confidential conversations allow each person to explain their perspective, concerns, goals, and expectations without interruption.

This gives the mediator a clear understanding of the issues while ensuring that everyone feels heard and respected from the very beginning.

Step 2: Joint Mediation Session

After meeting individually with each party, everyone comes together in a comfortable, neutral setting. Guided by the mediator, the discussion remains respectful, civil, and focused on solutions rather than conflict.

The mediator does not take sides or make decisions. Instead, the mediator helps facilitate productive conversations, identify common ground, explore options, and work toward a mutually acceptable agreement.

Step 3: Working Toward Resolution

Together, we discuss practical options, clarify misunderstandings, and negotiate solutions that address the needs and interests of everyone involved. Many disputes can be resolved in a single session, while more complex matters may require additional meetings.

Meeting Options

Our preferred approach is face-to-face mediation, conducted in a home, office, or other mutually agreed-upon location. Meeting in person often leads to better communication, stronger understanding, and more meaningful resolutions.

For clients who are unable to meet in person or simply prefer the convenience, we also offer secure virtual mediation sessions, allowing participants to join from wherever they are.

Our Commitment

Every person deserves to be treated with dignity and respect. We provide a safe, professional, and impartial environment where difficult conversations can become productive discussions and lasting solutions can be reached.

You don't have to face conflict alone. We're here to help you move from disagreement to resolution.

Mediation fees and scheduling

We look forward to helping you work toward a positive conflict resolution scenario. To reserve your mediation appointment, we require a $250 scheduling deposit at the time your session is booked.

Your deposit is applied directly toward your mediation fees—it is not an additional charge. It simply reserves your dedicated appointment time and allows us to prepare for your session.

Email info@chattanoogaconflictsolutions.com or text 770-802-3376 to book a consultation, or touch the yellow "schedule a consultation" button at the top of the page.

Rescheduling & Cancellations

We understand that life happens and unexpected situations can arise. If you need to cancel or reschedule your appointment, we kindly ask for at least 24 hours’ notice.

  • If you provide 24 hours or more notice, your $250 deposit will be applied to your rescheduled appointment.
  • Cancellations made with less than 24 hours’ notice, or missed appointments without notice, will result in the forfeiture of the deposit.
  • We understand that true emergencies happen, and those situations may be considered on a case-by-case basis.

Your time is valuable, and we believe ours is as well.

This policy helps ensure that appointment times remain available for clients who are ready to move forward while allowing us to provide each client with the time, attention, and preparation they deserve.

Thank you for your understanding and for choosing us to help you navigate life’s most important conversations.
